LARCENY. I
Niels Thorson, on remand from Townsville, was charged with the larceny of a spirit level, and other carpenter's tools, the property of William Lowther
Sub inspector Dillon appeared to prosecute and Mr. B. M. Lilley to defend.
Mr. Lilley asked for a remand, as he had not recoived any instructions in thc case. - Sub Inspector Dillon opposed the application.
He had all his witnesses here, and there was plenty of time yesterday for accused to have instructed his solicitor. It waa uufair to the
witnesses.-The Bench decided to go on with the euee.-After a pause Mr. Lilley asked the Bench to reconsider the matter. He knew nothing about the case. Th constable could not get back to Townsville until the end of the week. It would not place the prosecution in a false position at all. The Chairman said they did see any reason for the adjournment at present.
Octavius Coles, constable of police, Townsville, said ho escorted the accused from Townsville; he produced thc depositinns taken at Townsville, and also exhibit B (spirit level).
By Mr. Lilley : The depositions were taken in the presence of accused in open court.
Connelius Dwyer, constable,North Rockhampton, said on the evening of the 21st of February a man named Joseph Mitchener, living in North Rockhampton, had a conversation with witness and gave witness two hammers, five chisels, ten bits, one ratchet brace, one smoothing plane, a jack plane, one level, one oil can, one oil stone, one screwdriver, one gouge, one rasp, and one square; they were in a carpenter's bag ; Mitchener told witness something, and at the he same time showed him some writing; some of the tools were marked W.L.; Mr. Lowther was present at that time; Mr. Lowther had previously made a report about the tools, and on that evening he identified them as his property; witness took possession of the tools (produced).
Mr. Lilley objected to thc tools going in as an exhibit. The objection was overruled.
Joseph Mitchener, contractor, North Rock hampton, said he knew accused, who took a contract from witness about December of last year to build a house at North Rockhampton ; he worked at the contract till thc 15th of February; it was not completed then; accused left the work then, and had not been there since; on the I4th of February accused asked for money.
Mr. Lilley objected to the evidence of the selling of thc tools. It had not been proved that they were stolen yet.-The Chairman said it did not matter whether he tried to sell the tools or not. If it were proved he sold them, there was nothing to show that he stole them. The fact nf his trying to sell them was nothing.-Sub Inspector Dillon said it might iucrease the enormity of thc offence. The Chairman said it would not matter whether he sold the tools or not.-Sub Inspector Dillon said he would ask the witness to stand by. He (Sub Inspector Dillon) would prove the loss of the tools, and then bring tho witness back again.-The Chairman: I do not see that it would make much difference to the case.-Sub- Inspector Dillon: I am continuing the usual line of prosecution in larceny cases. If your Worships wish me to change it I will.-The Chairman: I do not follow you so far.-Sub-inspector Dillon : You will not let me prove the sale of thc tools. I will not press it.-The Chairman: At this stage we think it would be better for you to limit yourself to the question of stealing the tools.
William Lowther, builder, said he knew accused, and was in his (accused's) employment up till the 7th of February; witness had the usual carpenter tools there; on the 7th of February witness left the tools at the building for accused to take to a neighbouring house out of the way of the flood; witness said he would take thc tools up, but accused said he would do so as he knew the people better than witness; they generally kept the tools in a shed near thc new house under lock and key; they had kept the tools at a neighbour's house previous to the 7th of February; witness saw accused once after that, but they had uo conversation about the tools; he had not seen accused since then till in Court; witness made inquiries about thc tools and was told something about them, and in consequence went to see Mr. Mitchener; he showed witness an agreement and also his tools; witness afterwards made a report lo the police.
Witness had a paper in his hand which he kept looking at.- Mr. Lilley objected to this.-Sub Inspector Dillion asked the witness when he took the notes on the paper last night.-Mr. Lilley said if the witness could remember the date the night before he could do so that day.-Witness did not look at the paper further.
Witness, continuing, said it was after the 7th of February he saw Constable Dwyer at Mitchencr's place; he saw Mitchener give the constable some tools, which witness identified as his; some of the tools were branded W.L., and were the same accused offered to take up to the house; a spirit level was missing; the tools (produced) were witness's, and the bag too; the spirit level (produced) was witness's property; it formed portion of the tools that he had been working with; it was portion of tho tools left at the neighbour's house on a previous occasion; he never gave accused or anyone else authority to sell or dispose of thc tools; witness never sold them himself, and they were still his property ; he valued the tools at £2¡ he never gave accused authority to take the spirit level to Townsville.
By Mr. Lilley: After the tools were taken up to the house he saw accused and had a conversation with him; they never had a conversation about a spirit level.
Mr. Lilley said he knew absolutely nothing about the case, and his client asked to be allowed to ask the witness some questions. The Chairman said the Bench had no objections.
By accused: When they took the tools np to the house the first time accused did say he thought all witness's tools were in thc basket; witnesS did ask why the spirit level was not there, and accused replied that he had put it in his (accused's) box by mistake, but that it would be alright, and witness could get it by-and-bye.
By Sub-inspector Dillon : The box was put in the house with thc other tools; accused said he was going to a place on the Range to put up a kitchen, as he could not work at the house in the flood; accuscd went away by boat to the north; witness did not know that accused was going to the north; accused owed witness £4 in wages.
By the Bench: He never saw the tools after accused left on thc 7th of February.
Joseph Mitchener was called again and said that when accused asked for money witness said he could not give any more on account of thc contract; accused said he would give the tools as a security that he would finish the work; witness gave accused £1 and accused brought him thc bag of tools on the 15th of February; accused said he had plenty of tools and could leave some of them; witness told accused he could have the tools when the work was finished; witness wrote out the receipt (produced) which accused signed in witness's presence; accused said he was going to build a kitchen in the south side; on thc 15th of February witness gave him the flooring plane; Lowther wus present on thc 21st of February when witness handed the tools to Constable Dwyer; some of thc tools, he got from accused were branded W.L., and some of the tools (produced) had that brand; (the tools were like the ones he gave to the constuble he never saw accused again after that; accused never finished thc contract.
This concluded the case.
Accused elected to be dealt with by the Bench, and pleaded not guilty.
Accused made a statement to thc effect that he gave Mitchener the flooring cramp, and left the tools in his care because the woman could not keep them iu her house any longer as they were in thc way. When he went to Mitchener he had already had thc receipt written out. Witness asked Mitchener to take care of thc tools and he said all right. When he went back again end asked him for the cramp and got it, and after that he went to Townsville. He lind boen delayed finishing the house because he could not get material. Mitchener had promised to get it, but he had not done so.
Mitchener told him (accuscd) that it was getting sawn, but accused was told it could not be handled, as it was to wet through being under water. He had quite forgotten about the level being in his box, and wus very sorry. He never noticed it till he opened the box up in Townsville. He should have sent it back again only he had not the means to do so. He thought he was doing better by going to Townsville, but it was for thc worst. He had very little money, and had pawned some tools. He left the camp with Mitchener. He told the woman to tell Lowther that thc tools were ut Mitchener's place.
In answer to Mr. Kelly, accused stated thal Mitchener did not read thc receipt out to him, accused did not read it. Mitchener wrote it out.
Mr. Peterson, who had been sitting at the table with Mr. Lilley during the hearing of the evidence, said accused hud been in Rockhampton since he was a little bov, and was a very decent young fellow. His wife and family were at Townsville, and the first he (Mr. Peterson) knew of the trouble was seeing his name in the paper. Accused bore a very good character.
Mr. Lilley submitted there was no evidence of intent. He asked that the case be dismissed.
Thc Chairman said they could not dismiss the case on the evidence, but would take a lenient view of the case. Accused had had a very narrow escape. He would be fined 40s. or a week's imprisonment.
An order was made for the return of the tools to Lowther.
