Language difficulties arose in the Court of Petty Sessions yesterday afernoon when 29 Javanese seamen were charged with wilfully disobeying a lawful command of their captain on July 16.
The defendants appeared before Mr. E. L. Moore. Acting S.M.. and the charge was made by Captain Hermanus Koning acting on istructions from the Netherlands Consul in Australia.
Mr. J. J. Bell, of MacDonnell, Harris and Bell, on behalf of Captain Koning, said that the complaint was made un der the Commonwealth Navigation Act. He said that the defendants,,who were of Javanese nationality, were not prepared to continue the voyage with the ship, and had refused to obey the captain's order to proceed on to the ship. The men had been ordered twice by the captain and when they disobeyed the third time the captain had sought authority to institute proceedings against them.
The second officer of the ship acted as interpreter, 'and. acting on instructions from the Magistrate, asked the men if they had anything they could sell to pay a fine, after they had all pleaded guilty. All replied that, they had no property, they could sell, and no money. The ' Magistrate fined] each of the men £10, with 6/- costs of court, in default' one month's imprisonment in the Townsville gaol.
The defendants elected to go to gaol in preference to paying the fine.

DECORATION FOR DUTCH MARINER
Captain H.. Koning, at the Netherlands Consulate. Sydney, after he had been awarded the Netherlands Bronze Cross for bravery and exemplary behaviour.
The decoration was conferred upon Captain Koinng by Queen Wilhbelmlna for his courage and tactful action during a Japanese attack in the Gulf of Bengal on April 6, 1942. Consul-General Pennink mentioned in his speech Captain Koning's extraordinary record as for instance, when he brought the Royal Packet ship, Van de Capellen with two oil lighters in tow, cleverly camouflaged with branches and leaves, safely into Padang Harbour (West Sumatra), despite heavy Japanese air attacks. On another occasion, the Allied Naval Command requested him to save members of the crew and soldiers who were aboard a Dutch freighter which was sunk by the Japanese. Captain Koning landed the surviving members of the crew and the soldiers in Padang, after which he safely reached Batavia. with, in the meantime, a heavily damaged ship. After the necessary repairs had been made in record time, he left for the Bay of Bengal, where he was attacked by Japanese planes, of which one was shot down by the ship's gun. Subsequently, the ship was so disabled by the attacks, that she had to be abandoned, after having been set on fire by Captain Koning, who was the last to leave the ship.
